BOC Shares Go Up Despite Manganese Lawsuits Pending

Shares in the British industrial gases group BOC edged up after the company revealed it had been successful in an appeal against a $174 million legal charge. Despite the legal victory over an accused breaching a memorandum of understanding on a contract allegation, the company was facing about 9,500 manganese exposure lawsuits from 8,525 lawsuits it reported in May.
The manganese exposure lawsuits are in connection with welding fumes given off from manganese rods made by the company. In October 2003, BOC lost a manganese exposure lawsuit in Illinois. The suit alleged welding fumes led a man to develop Parkinson's disease, and the company has said it would appeal the verdict. BOC's chief executive said the company has no intention of settling any manganese exposure cases.
